ONTARIO MUNICIPAL BOARD (OMB)

On occasion planning applications find their way to the Ontario Municipal Board (OMB) either on appeal by the landowner/developer applicant from a decision or lack of decision from the municipal approval authority, or an appeal filed by an interested party to the decision issued by the approval authority.

Should such an appeal be filed, the OMB will deal with the merits of the appeal and the planning proposal as a hearing “de nova”. One of the considerations in determining the final outcome on an appeal is the quality of the expert evidence presented at the hearing.
